Family and Employment Based Green Card/Permanent Residence Status
Any green card holder or lawful permanent resident has the right to live and work in the United States. The two most common ways a green card can be obtained are through employment or through connection to a family member who is a U.S. citizen or lawful permanent resident. Three Steps to Obtain a Permanent Employment Visa:
- Labor Certification Application: In most situations, employers must conduct specific real-world recruitment of U.S. citizens before filing an application for alien employment certification with the U.S. Department of Labor (DOL). This application is commonly referred to as the "PERM labor certification process."
- Immigrant Visa Petition for Alien Worker: After the PERM labor certification application has been approved by DOL, the company files an Immigrant Petition for Alien Worker with the U.S. Citizenship and Immigration Services (USCIS).
- Green Card: An employee can apply for adjustment of status to become a permanent resident of the U.S. during a month when his or her employment-based "priority date" is available, according to the U.S. Department of State's monthly "Visa Bulletin."
